Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in connection with Ghosi P.S. Case No. 273 of 2020 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 326, 307, 504 of the Indian Penal Code and Section 27 of the Arms Act. As per the prosecution case, on 04.07.2020 at about 8.00 P.M., while the informant was at her Dalan, all the F.I.R. named accused persons including this petitioner armed with deadly weapons came there and started abusing and asked about Rajeev. On hulla, mother-in-law, father-in-law, Rajeev Prasad and informant's husband Vimlesh Prasad came there and aske not to abuse. Thereafter, all the accused persons attacked them and when informant's mother-in-law came to save, co-accused Lalit Yadav and Matang @ Ramanuj opened fire and mother-inlaw sustained gun shot injury.

Patna High Court CR. MISC. No.4624 of 2021(2) dt.26-03-2021 2/2 Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case. There is case and counter case between the parties. He further submits that similarly situated co-accused have been granted bail by different Co-ordinate Bench of this Court. Petitioner is in jail custody since 05.07.2020 and there is general and omnibus allegation against the petitioner. There is specific overt act against Lalit Yadav and Matang @ Ramanuj. Petitioner has got no any criminal antecedent.

Learned A.P.P. for the State opposed the bail petition. In the facts and circumstances of the case, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) only with two sureties of the like amount each to the satisfaction of learned C.J.M., Jehanabad in connection with Ghosi P.S. Case No. 273 of 2020.
