JUSTICE SUDHIR SINGH ORAL ORDER 20-02-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 302 and 120(B)/34 of the I.P.C. Accusation is that the petitioner along with some unknown in a planned manner under conspiracy committed murder of the brother of the informant.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 5.3.2016 and the charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. It is at best a case of last seen. There is no circumstantial evidence to suggest his implication in

Patna High Court Cr.Misc. No.36069 of 2016 (4) dt.20-02-2017 the present case.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Gopalganj in connection with Meerganj P.S. case No.61 of 2016.
