JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

The name of petitioner came in this case in confessional statement of co-accused, Ajay Singh, who disclosed that petitioner was also involved in conspiracy of committing the murder of the deceased. Moreover, even if the aforesaid confessional statement assumed to be true, then also, petitioner had not taken active part in committing the murder of the deceased. Petitioner is in jail custody since 29.11.2015 and the

Patna High Court Cr.Misc. No.11237 of 2016 (2) dt.10-03-2016 2/2 investigation against him appears to have already been completed. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Sitamarhi P.S. Case No. 790 of 2015.
