The petitioner apprehends his arrest in connection with Nabinagar P.S. Case No.165 of 2017, registered under Section 379 of the Indian Penal Code and Section 40 of the Miner Minerals Concession Rules.
Allegation is that illegal sand was found laden in the tractor of the petitioner and the driver fled away leaving the tractor.
Learned counsel for the petitioner submits that the petitioner is the owner of the tractor, the driver was transporting the sand having all the required papers and the tractor driver, namely, Kamlesh Kumar has been granted anticipatory bail by a
Patna High Court Cr.Misc. No.52892 of 2017 (2) dt.09-11-2017 2 /2 coordinate Bench of this Court vide Cr. Misc. No.46335 of 2017 on 22.09.2017 and this petitioner has got no criminal antecedent. Having considered the said facts and circumstances, let petitioner, named above, in the event of arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1, Aurangabad in connection with Nabinagar P.S. Case No.165 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C. (Arun Kumar, J.) S.Kumar/- U T
