1. Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 109, 74, 352, 351(2) and 3(5) of the B.N.S.
3. The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that on account of dispute relating to land and on orders of Shamya Bihari Yadav, the petitioner assaulted her husband by rod causing injury on head. Further, when informant and her son came to save them, the accused assaulted them causing injury on head.
4. The learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.47578 of 2025(2) dt.30-07-2025 2/3 the informant is own Bhabhi of the petitioner and is wife of his elder brother Rajesh. It is next submitted that father in-law instituted Tilauthu P. S. Case No.124 of 2025 wherein it is alleged that his elder son Rajesh and his grandsons i.e. sons of Rajesh came and assaulted the petitioner and the informant tried to save him, he was also assaulted along with his wife and daughter in-law. The learned counsel thus submits that the father in-law of the informant instituted Tilauthu P. S. Case No. 124 of 2025 with the aforesaid allegation which amply demonstrates that the husband of the present informant and her family were instrumental in assaulting the petitioner along with the father inlaw, mother-law and sister in-law of the present informant.
5. Learned A.P.P. opposes the anticipatory bail application.
6. Considering the submissions made by the learned counsel for the petitioner and taking into consideration the order dated 30.07.2025 in Cr. Misc. No.47575 of 2025, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on anticipatory bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sri
Patna High Court CR. MISC. No.47578 of 2025(2) dt.30-07-2025 3/3 Praveen Kumar, the learned Judicial Magistrate, 1st Class, Dehri, Rohtas in connection with Tilauthu P. S. Case No.123 of 2025, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
