JUSTICE MOHIT KUMAR SHAH ORAL ORDER 15-03-2018 Heard the learned counsel for the petitioners and the learned A.P.P. for the State.
This is an application for grant of anticipatory bail in connection with Mehandia PS case no. 56 of 2017 registered for the offences punishable under Sections 366(a)/34 of Indian Penal Code.
The allegation is regarding victim girl being abducted and thereafter, she being forcibly married with one Vikas Kumar. The learned counsel for the petitioners submits that this Court by an order dated 23.02.2018 had directed for recording the statement of the victim girl under Section 164 of Code of Criminal Procedure. It appears that the statement of victim girl has
Patna High Court Cr.Misc. No.54712 of 2017 (6) dt.15-03-2018 2/2 been recorded under Section 164 of Code of Criminal Procedure on 24.02.2018 and from the said statement, it appears that she has, on her own, fled away with one co-accused Vikash Kumar and solemnized marriage with him. It is further submitted that the statement of the victim girl recorded under Section 164 of Code of Criminal Procedure would bear it out that the petitioners herein neither have any complicity in the matter nor any allegation of committing any sort of misdeed has been leveled against them.
Having regard to the facts and circumstances of the case, the abovenamed petitioners, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt/ production of a copy of this order, are directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Arwal in connection with Mehandia PS case no. 56 of 2017 subject to the conditions as laid down under Section 438(2) of Code of Criminal Procedure.
