Petitioner happens to be husband of the deceased and is languishing in jail custody since 29.04.2015 in a case registered for the offences punishable under Sections 304B/34 of the Indian Penal Code.
The marriage of petitioner had taken place with deceased seven years ago as it is admitted by the prosecution itself that after marriage, deceased gave birth to three children out of the aforesaid wedlock. No doubt, the deceased died in other than normal circumstances and the cause of death of deceased was found asphyxia due to hanging but police after
Patna High Court Cr.Misc. No.12023 of 2016 (2) dt.18-03-2016 2/2 investigation, submitted charge sheet under Section 306 of the Indian Penal Code.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Sadar, East Champaran, Motihari in connection with Rajepur P.S.
