The petitioner seeks bail in a case registered for the offence under Sections 30(a) / 41(i) of Bihar Prohibition and Excise Act.

1752 liters & 480 ml. of illicit foreign liquor have been recovered from a truck and driver of the said truck, who was apprehended on spot, disclosed the name of petitioner, as the person who got loaded the liquor in the truck. It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner. Petitioner has got one criminal antecedent of similar nature and he is in custody since 09.07.2021.

Learned A.P.P. for the State has opposed the bail petition.

No.58728 of 2021(2) dt.17-12-2021 2/2 Considering the fact that petitioner has got one criminal antecedent of similar nature, the learned court below, where the case is pending, is directed to release the petitioner on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Kuchaikote P.S. Case No. 234 of 2020 after framing of the charge.
