2. The petitioner apprehends his arrest in connection with Sursand P.S. Case No. 186 of 2026 registered under Sections 126(2), 115(2), 352, 64, 3(5) of BNS.

Allegation in the F.I.R is that on pretext of treatment co-accused, Abhinek Kumar @ Monu took away the informant at Sitamarhi hospital where Sonu Kumar @ Balbikee (Petitioner) was present and they by alluring the informant on pretext of marriage, took her from Sitamarhi to Patna by bus and in the night from Patna to Pune by train and kept her there and

It is submitted by learned counsel for the petitioner that narration of facts in the First Information Report would reveal that the main allegation of alluring the informant on the pretext of marriage and keeping her for five months at Pune was on Abhinek Kumar @ Monu. So far as the present petitioner is concerned, it is submitted that he was also present and he happened to be the brother of said Abhinek Kumar @ Monu. It is further submitted that the First Information Report was lodged after inordinate and unexplained delay inasmuch as the FIR was lodged on 08.04.2026 referring to the first date of occurrence as 10.11.2025. It is also submitted that the petitioner has no criminal antecedent and he undertakes to co-operate during investigation/trial.

5. The application for anticipatory bail is opposed by learned A.P.P. for the State.

6. Taking into consideration the aforesaid facts and circumstances of the case and also considering the fact that there is allegation against Abhinek Kumar @ Monu and the petitioner has been made accused only

No.46662 of 2026(2) dt.22-07-2026 3/3 on account of he being his brother, it is directed that the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Sursand P.S. Case No.186 of 2026 on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court concerned where the case is pending/successor Court, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure/Section 482(2) of the B.N.S.S, 2023, subject to further conditions that:

(i) One of the bailors would be family members/close relative of the petitioner.

(ii) The petitioner would co-operate investigation/trial and they would make himself available before the Investigating Officer of the case as and when required.
