JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 13-05-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in connection with Jandaha P.S. Case No. 95 of 2012 registered for the offence punishable under section 392 of the Indian Penal Code. The prayer for bail of the petitioner was earlier rejected vide order dated 27th September, 2013 passed in Cr.Misc. No. 41851 of 2013.

It has been contended that though the petitioner is in custody since 15th June, 2013 and charges have been framed on 21st January, 2014 but till date not a single witness has been examined on behalf of the prosecution in support of the charge.

Patna High Court Cr.Misc. No.20127 of 2015 (2) dt.13-05-2015 2/2 Regard being had to the facts and circumstances of the case, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Vaishali at Hajipur in connection with Jandaha P.S. Case No. 95 of 2012, corresponding to Tr. No. 6398 of 2014.
