JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 12 of POCSO Act and Section 3 (i) (x) of S.C./S.T. (Prevention of Atrocities) Act. Petitioner and his associates used to tease the informant and other girls but according to written report itself, petitioner was not caught on the spot and his name was disclosed by the co-accused, who was caught on the spot. Moreover, petitioner is in jail custody since 07.02.2016 and does not have any criminal antecedent.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.12262 of 2016 (2) dt.29-03-2016 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-cum-Special Judge, Bettiah, West Champaran in connection with Mainatand P.S. Case No. 08 of 2016.
