JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 379, 272, 273, 420/34 of the Indian Penal Code and Section 47 A of the Excise Act. Petitioner was neither caught on the spot nor anything was recovered from his conscious possession. The alleged recovery was made from pick-up van and petitioner is said to be owner of the aforesaid pick-up van. No doubt, petitioner carries criminal antecedent of several cases but in the instant case, except involvement of his vehicle in the alleged crime, there is nothing against the petitioner.

No.11397 of 2016 (2) dt.15-03-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran, Motihari in connection with Pipra Kothi P.S. Case No. 95 of 2014.
