JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-04-2016 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 24.09.2015 in a case registered for the offences punishable under sections 498A of the IPC and under section 3⁄4 of Dowry Prohibition Act.
This is a case of misuse of privilege of bail. It is submitted by learned counsel for the petitioner that petitioner was granted bail but thereafter he could not appear before the trial court as he was leading life of a saint in mountains. It is further submitted that petitioner undertakes to appear on day to day basis in the trial. No progress has been made in trial and petitioner is in custody for more than six months Considering the aforesaid facts, let the above named
Patna High Court Cr.Misc. No.11431 of 2016 (2) dt.05-04-2016 2/2 petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Sunil Kumar, learned Judicial Magistrate, 1st class, Supaul in connection with Tribeniganj P.S. Case No. 70 of 1999, G.R. No. 444/1999.
The learned court below shall be at liberty to cancel the bail bonds of the petitioner in case the petitioner defaults without any reasonable cause on two consecutive occasions. (Dinesh Kumar Singh, J) BKS/- U T
