2. The petitioner seeks bail in connection with Baikunthpur P.S. Case No. 113 of 2019 registered for the offence punishable under Section-302/34 of the Indian Penal Code.

3. As per allegation, co-accused, Samsad Sai, who was husband of the deceased was consuming liquor in room of his wife (deceased) along with the present petitioner. When the deceased opposed, the accused persons started assaulting her.

4. Learned counsel for the petitioner has submitted that the petitioner is not family member of the deceased and he

Patna High Court CR. MISC. No.56853 of 2025(4) dt.31-10-2025 2/2 has no concern with the occurrence. He is a neighbour. According to postmortem report, the cause of death is asphyxia. He has also submitted that the informant has compromised the case.

5. On the otherhand, learned counsel appearing for the State has opposed the prayer for bail by submitting that in paragraph-3 of the case diary, it has clearly been mentioned that the petitioner, Manan Sai and Sadam Sai strangulated the deceased to death.

6. Considering the aforesaid facts and circumstances, I am of the view that the petitioner does not deserve bail and accordingly, the same is rejected.
