The petitioner apprehends his arrest in connection with Darauli P.S. Case No.38 of 2019 registered under Sections 272, 273, 420 and 120(B) of the Indian Penal Code besides Sections 30(a) and 38(i) of the Bihar Prohibition and Excise Act, 2016.
The accusation is that in course of checking of the truck container bearing registration no.HR69C7157, 3447.72 liters Indian Made Foreign Liquor, kept in different cartoons, was recovered. The truck container driver disclosed his name as Sanjeev Kumar and also disclosed that on the instruction of Rinku Pandey, Mantu Yadav and Vijan Sah, who are present in
Patna High Court CR. MISC. No.46053 of 2019(2) dt.25-07-2019 2/2 the Scorpio vehicle bearing Registration No.BR29PA4544, the said liquor is being carried by him. The informant along with other police personnel received secret information about having hand of the petitioner in doing the business of illicit liquor. Learned counsel for the petitioner submits that neither the petitioner is the owner of the seized truck container nor he was apprehended on the spot. Only the informant and other police personnel received secret information that the petitioner is involved in doing the business of illicit liquor. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.
10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cumSpecial Judge (Excise), Siwan, in connection with Darauli P.S. Case No.38 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C.
