Petitioner seeks bail in a case registered for the offences punishable under Sections 302 and 120B of the Indian Penal Code.

Petitioner is not named in the first information report nor informant appears to be eye witness of the alleged occurrence. It would appear from perusal of the impugned order as well as from submissions of the parties that after one year of institution of the present case, the mobile of the deceased was recovered from possession of the petitioner and except the aforesaid material, there appears to be nothing against the petitioner, who is

Patna High Court Cr.Misc. No.11259 of 2016 (2) dt.11-03-2016 2/2 languishing in jail custody since 24.11.2015. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Railway Judicial Magistrate, Samastipur in connection with Samastipur (Rail) G.R.P. P.S. Case No. 86 of 2014.
