Learned counsel for the petitioners is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.

The petitioners are apprehending their arrest in

Patna High Court CR. MISC. No.6630 of 2021(2) dt.03-12-2021 2/3 a case registered for the offences punishable under Sections 341, 323, 354, 379, 504, 506, 34 of the Indian Penal Code.

The prosecution case as per F.I.R is that all the accused persons including the petitioners entered into the house of the informant and made assault and when her husband came to her rescue, he was also assaulted. The accused persons also taken away cash of Rs. 10,000/- from the pocket of the husband of the informant and threatened of dire consequences. It is submitted by learned counsel for the petitioners that there is general and omnibus allegation against the petitioners. The petitioners and the informant are agnates. A statement has been made in para 3 of the petition that petitioners have no criminal antecedents.

Case No. 559 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
