JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-04-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307 and 504 of the Indian Penal Code.

In the background of dispute with regard to measurement of the land it is alleged that the petitioner assaulted with spade on the head of the informant when brother and son of the informant came to rescue then they were also assaulted. It is submitted by the learned counsel for the petitioner that the accusation has been levelled in the background of land dispute and the injury has been found to be simple superficial in nature and the informant has retracted from his initial version, a petition to that effect has been filed before the

Patna High Court Cr.Misc. No.19635 of 2015 (2) dt.29-04-2015 2/2 learned court below. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Madhubani in connection with Arer P.S. Case No.19 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
