JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 452, 376, 511, 379/34 of the Indian Penal Code.
The accusation against the petitioner is that he along with two others caught the informant with bad intention but informant raised alarm which attracted the villagers, who caught the petitioner along with his motorcycle on the spot. Petitioner is in jail custody since 14.10.2015 and submission on behalf of the petitioner is that he was caught by the villagers on mere suspicion and as a matter of fact, he had gone to meet his sister and had parked the motorcycle near the house of

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Madhubani in connection with Jai Nagar P.S. Case No. 275 of 2015.
