JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-07-2019 Petitioner seeks bail in anticipation of her arrest in connection with Complaint Case No. 2047 of 2014 instituted for the offence punishable under Section 420 of the Indian Penal Code.
Allegation against the petitioner, who happens to be daughter of the complainant, is that she got a sale deed executed with respect to land from the complainant by playing fraud upon her by obtaining her signature on the plea of old aged pension. Submission of learned counsel for the petitioner is that she has falsely been implicated in this case due to property dispute between the parties and petitioner is a lady and she is ready to abide by any condition that may be imposed on her.

In view of above facts and circumstances, let petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya, in connection with Complaint Case No. 2047 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition is that petitioner has to co-operate in the disposal of the case, otherwise her bail bonds shall be cancelled.
