JUSTICE DINESH KUMAR SINGH ORAL ORDER 25-06-2015 Heard learned counsels for the petitioners and learned APP for the State.
The petitioners are languishing in custody since 13.01.2015 in a case registered for the offences punishable under section 302/34 of the Indian Penal Code and 27 of the Arms Act. It is alleged that initially petitioner Heera Lal Yaday
Patna High Court Cr.Misc. No.19465 of 2015 (3) dt.25-06-2015 2/2 made three rounds of firing but it did not cause any injury. Subsequently, co-accused Subodh Yadav fired on the chest of the father of the informant, as a result, he died on the spot. It is submitted by learned counsel for the petitioners that as per the FIR no injury was caused by these petitioners and investigation has already concluded.
Considering the aforesaid fact, let the above named petitioners be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Sultanganj P.S. Case No.305 of 2014.
