2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 191(2), 191(3), 190, 329(3), 115(2), 352, 351(3) and 351(2) of the B.N.S. and Section 27 of the Arms Act.

The prosecution case, in brief, is that informant, namely Raj Kumar, alleged that on 03.03.2025 at about 2:30 PM, when he was ploughing his field in the meantime all the F.I.R. named accused persons, including this petitioner and 10 unknown persons came to informant's field firing with desi katta and all of them abused and assaulted informant and his family members and due to fear, informant party fled in order to save their life.

4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has committed no offence. Prior to lodging of the present F.I.R., Phulwaria P.S. Case No. 28 of 2025 was lodged by one Shobha Devi, who happens to be aunt of this petitioner, against informant and others and in retaliation, this false and concocted case has been lodged with general and omnibus allegation of assault only with a view to save their skin from the aforesaid case. As a matter of fact, land dispute is prevailing between the parties since long and both parties are claiming their right and title over a piece of land due to which a scuffle took place between the parties.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.

6. Considering the facts and circumstances of the case, general and omnibus nature of accusation and case and counter-case between the parties, the prayer for grant of anticipatory bail to the petitioner is allowed.

7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs.
