Petitioner seeks bail in a case registered under section 290 of the Indian Penal Code as well as section 47A of the Excise Act. Petitioner and two others are said to have been arrested by the police while they were found indulged in manufacturing illegal liquor and it is stated that 200 liters country made liquor and other apparatus which are said to be used in manufacturing liquor were recovered from the spot.

Petitioner does not have any criminal antecedent and is languishing in jail custody since 27.12.2015. Taking into consideration that alleged recovery has not been made from conscious possession of the petitioner, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Sri Hare Ram,
