Petitioner seeks bail in Sahebpur Kamal P.S. Case No.101 of 2018 registered under Sections 420, 467, 468, 414, 120B and 34 of the IPC and Section 30(a) of the Bihar Prohibition and Excise Act.

The petitioner is a driver of the truck and from the truck, a huge quantity of liquor was recovered. Prayer for bail of the petitioner was earlier rejected by order dated 26.10.2018 with liberty to the petitioner to renew his prayer for bail, if the trial is not concluded. From perusal of the report of learned Special Judge, it appears that three witnesses have already been examined and six more months' time is required for conclusion of trial.

Patna High Court CR. MISC. No.48748 of 2019(5) dt.16-11-2019 2/2 Having considered the facts aforesaid that a huge quantity of liquor was recovered from the truck driven by the petitioner, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.

The trial court is directed to hold the trial on day to day basis and conclude the trial within four months from the date of receipt of this order. If the trial is not concluded within four months from the date of receipt of this order, the petitioner may renew his prayer for bail thereafter.
