JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 413, 414, 420, 467, 468, 471/34 of the Indian Penal Code.

One Laddan Khan was arrested by the police with stolen motorcycle and the aforesaid Laddan Khan disclosed that he along with petitioner and some others used to sell and purchase the stolen motorcycle. The aforesaid Laddan Khan disclosed that petitioner is tenant of one Bhutani Sah and had kept the stolen motorcycles in the premises of aforesaid Bhutani Sah. Subsequently, police went there and seized some stolen

Patna High Court Cr.Misc. No.11639 of 2016 (2) dt.15-03-2016 2/2 motorcycles from the house of aforesaid Bhutani Sah. Contention on behalf of the petitioner is that petitioner was tenant of Bhutani Sah and as a matter of fact, the aforesaid Bhutani Sah wanted to get his premises vacated and that is the reason he implicated the petitioner in the present case in collusion with police. It is further contended that alleged recovery has been made from the house of Bhutani Sah and the aforesaid Bhutani Sah has himself put his signature on the seizure list as witness. It is further contended that petitioner does not have any criminal antecedent and as a matter of fact, he deals in medical business which has been admitted by the aforesaid co-accused, Laddan Khan himself.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Bettiah, West Champaran in connection with Bhangaha P.S.
