JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 392, 511 of the Indian Penal Code.

Petitioner is not named in the first information report but in course of investigation, the name of one Sikandar Mukhiya and his companions surfaced in this case. Subsequently, some witnesses claimed to have seen the petitioner and some others fleeing towards the village just after the alleged occurrence. Moreover, nothing has been recovered from conscious possession of the petitioner and the recovery of stolen mobile is said to be made from possession of co-accused, Sikandar Mukhiya.

No.11441 of 2016 (2) dt.15-03-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Sonbarsa P.S. Case No. 166 of 2014.
