Mr.Navin Kumar Pandey, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 30-07-2025 Heard Mr. Dhananjay Kumar Pandey, learned counsel appearing on behalf of the petitioner and Mr. Navin Kumar Pandey, learned APP for the State.

2. The petitioners seek pre-arrest bail in connection with Belhar P.S. Case No. 358/24 registered for the offence(s) punishable under Sections 191(2), 190, 126(2), 115(2), 121(1), 221, 132, 352, 351(2), 303(2), 324(4) and 326(b) of the BNS.

3. As per the allegation made in the FIR, the accused persons named therein including the petitioners have obstructed the police force in performing their official duty by pelting bricks and stones upon them.

4. Learned counsel appearing on behalf of the

Patna High Court CR. MISC. No.46774 of 2025(2) dt.30-07-2025 2/3 petitioners submitted that petitioners are innocent and have falsely been implicated in the present case. He further submitted that general and omnibus allegation has been levelled against the petitioners.

5. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail.

6. Having considered the rival submissions made on behalf of the parties, as well as, the fact that general and omnibus allegation has been levelled against the petitioners, I am of the opinion that petitioners have, prima facie, made out a case to be released on pre-arrest bail.

7. The petitioners, above named, are directed to be released on pre-arrest bail, in the event of their arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate Banka / Concerned Court in connection with Belhar P.S. Case No. 358/24, subject to the conditions as laid down under Section 482(2) of the BNSS.

8. The learned District Court is directed to verify the criminal antecedents of the petitioners and if it is found that the
