1. Heard learned counsel for the petitioners and learned APP for the State.
2. The petitioners seek bail in anticipation of their arrest in a case registered for the offences punishable under Sections 338, 336(3), 340(2), 319(2), 318(4), 111, 352, 351(2), 3(5) of the B.N.S.
3. The learned counsel for the petitioners submits that the petitioner no.1 has antecedent of one case under the Excise Act and petitioner no.2 is a person with clean antecedent. It is next submitted that Ramdayal Mahto @ Ramdayalu Mahto along with Kumud Kumar and Sunil Kumar Mahto seeking anticipatory bail by filing Cr. Misc. No.48834 of 2025 and the same was allowed by an order dated 12.08.2025 after considering the case on merits and
Patna High Court CR. MISC. No.59186 of 2025(3) dt.10-10-2025 2/2 in detail. It is further submitted that Ramdayal Mahto along with Kumud Kumar and Sunil Kumar Mahto are alleged to be the purchaser of the land whereas the petitioners are alleged to be identifier on the sale deed.
4. Learned A.P.P. opposes the anticipatory bail application.
5. Considering the submissions made by the learned counsel for the petitioners and taking into consideration the order dated 1208.2025 in Cr. Misc. No.48834 of 2025, the petitioners, above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks, are directed to be released on anticipatory bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM-1, Dalsinghsarai, Samastipur in connection with Dalsinghsarai P. S. Case No.5133005250173 dated 15.05.2025, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
6. The application stands allowed.
