2. The petitioner apprehends his arrest in a case registered for offence under Sections 302/34 of the Indian Penal Code.

3. Petitioner is named in the F.I.R. with specific accusation that he alongwith co-accused Ghorwa Yadav came at the house of informant and took away the son of informant with them and later on, his (informant's son) dead-body was found near pond. Throat of the son of informant was swollen, blood was coming from his eyes and both cheeks were swollen.

4. Learned counsel for the petitioner submits that informant is not eye-witness of the occurrence and only on suspicion, petitioner has been made accused. In fact, the deceased died due to drowning in pond.

5. However, learned A.P.P. for the State vehemently opposes the prayer for anticipatory bail and submits that petitioner is named in the F.I.R. and he was last seen with the deceased and on his disclosure, the dead-body of informant's son was found near pond.

6. Considering the aforesaid facts and circumstances, the prayer for anticipatory bail of petitioner is rejected. (Prabhat Kumar Singh, J) anay U T
