1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The present application has been filed for modification of the order dated 28.08.2024 passed in Cr. Misc. No. 49833 of 2024 whereby the present petitioner has been granted privilege of anticipatory bail subject to the condition that the petitioner shall surrender before the learned court below within a period of six weeks from the date of order.

3. Learned counsel for the petitioner submits that the instant case is pending within the jurisdiction of Samastipur Civil Court

Patna High Court CR. MISC. No.61323 of 2025(3) dt.12-09-2025 2/2 but due to slip of pen in the prayer portion of the earlier modification petition as well as in the anticipatory bail application the word to the satisfaction of "the learned court of Sub Divisional Judicial Magistrate, Dalsinghsarai, Samastipur" has been mentioned though the case is pending before "the learned court of Sub Divisional Judicial Magistrate, Samastipur". The petitioner was searching the order in Samastipur and when it was traced out by that time the stipulated time had already elapsed. He, accordingly, prays for further two weeks time to surrender before the learned District Court.

Having regard to the submissions made on behalf of the petitioner, let the time granted by this Court to surrender before the court of learned Sub Divisional Judicial Magistrate, Samastipur by order dated 28.08.2024 passed in Cr. Misc. No. 49833 of 2024 be extended by further two weeks from today.

5. Accordingly, this application is allowed to the extent indicated above.
