JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-09-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The name of the petitioner came in confessional statement of Mantosh Turha who happens to be full brother of the petitioner. Even if, confessional statement of Mantosh assumed to be true, then also, the only allegation against the petitioner is of conspiracy and according to above-said confessional statement itself, it were co-accused, Mantosh Turha and one other, who committed the alleged crime.

Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Guthani P.S. Case No. 178 of 2014 corresponding to Sessions

Patna High Court Cr.Misc. No.19377 of 2015 (4) dt.21-09-2015 2/2 Trial No. 18 of 2015 to the satisfaction of learned Additional District & Sessions Judge-III, Siwan.
