2. The petitioner is apprehending his arrest in connection with C.R Case No. 689 of 2022 for the offence under Sections 323, 341, 504, 506, 354, 498-A, and 420 of the Indian Penal Code and section 3 and 4 of the Dowry Prohibition Act lodged on 28.07.2022 by the complainant, Shweta Kumari.

3. On 21.08.2024, when the learned counsel for the petitioner tried to impress upon this Court that the lady is residing with accused with full dignity and honour, learned counsel for the complainant had disputed the same.

4. In that background, this Court wanted the couple to be present in the Court.

5. Today on call, it has been informed by the learned counsel for the petitioner that it seems that the complainant gave incorrect facts as despite informing him, today he do not have any information whether he will come or not.

6. Learned counsel for the complainant has taken this Court to the complaint to show that after the birth of the female child, the torture has increased. It is the further submission that the female child of the couple is residing with the maternal grandparents as the husband is not keeping her in good health.

7. Considering the allegation that has come as also the submissions put forward by the parties, the petitioner has continued with his torture, the Cr. Misc. No 50737 of 2024 is rejected and the interim relief granted on 21.08.2024 stands vacated.
