JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-04-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 10.07.2009 in a case registered under section 363, 328, 307, 379, 411 and 34 of the Indian Penal Code and section 21 and 22 of the N.D.P.S Act. The allegation against the petitioner is that he along with one other administered intoxicating thing to driver of Bolaro Jeep but petitioner and his associates were caught by the informant and handed over to the police. Petitioner does not have criminal antecedent of similar nature and earlier the prayer for bail of the petitioner was twice rejected by a co-ordinate Bench of this Court but while rejecting the prayer for bail of the petitioner a co-

No.4201 of 2015 (3) dt.23-04-2015 2/2 ordinate Bench of this Court gave liberty to the petitioner to renew his prayer for bail before the trial court after commencement of his trial. The trial court has reported that charge against the petitioner was framed on 13.10.2014 but up till now not a single prosecution witnesses could not be examined.
Considering the aforesaid facts and circumstances as well as submissions of the parties and also keeping in mind the period of detention of the petitioner in jail custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of 4th Additional Sessions Judge, Muzaffarpur in connection with trial no. 123 of 2012/ 32 of 2014 arising out of Muzaffarpur Rail P.S.Case No. 42 of 2009, subject to condition that one of the sureties must be a close relative of the petitioner.
