JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-302, 120(B)/34 of the Indian Penal Code . Petitioner appears to be named in the first information report along with other accused but only suspicion has been raised against the petitioner and others. Moreover, in course of investigation, petitioner was arrested and confessed his guilt, and except the confessional statement as well as suspicion, there appears to be nothing against him. Moreover, having more or less similar allegation, one co-accused namely, Sheru @ Umar Farukh has already been granted privilege of bail by a coordinate bench of this court.

No.12228 of 2016 (2) dt.29-03-2016 2/2 Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Korha P.S. Case No. 81 of 2014 to the satisfaction of Chief Judicial Magistrate, Katihar.
