2. The petitioner is apprehending arrest in connection with Complaint Case No. 87 of 2024, for the offence punishable under Sections 406, 417, 419, 420, 467, 468, 471, 504, 506 and 120(b) of Indian Penal Code and also under Section 138 N.I Act but cognizance has been taken only under Section 420, 120(b), 506 of I.P.C and also under Section 138 N.I Act.

3. As per the prosecution, informant has alleged that she has transferred Rs. 34 lakhs to the husband of the petitioner who is Director of Pioneer Engineering Company, out of which

Patna High Court CR. MISC. No.49152 of 2026(2) dt.22-07-2026 2/3 Rs. 11 Lakhs has been returned and rest Rs. 23 lakhs is still with the husband of the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case because she is the wife of the Director of Pioneer Engineering Company. The counsel lastly submits that the cheque, which bounced, was issued by Sanobbar Uzzamman, who is Director of Pioneer Engineering Company.

5. Learned APP for the State vehemently opposes the prayer for bail of the petitioner.

6. Having heard the parties and considered the aforesaid facts. In view of the fact that the petitioner is merely the wife of the Director of Pioneer Engineering Company and has no role in the company, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the Trial Court within a period of six weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) as mentioned in Section 2(1)(d) of the B.N.S.S., 2023 to the satisfaction of learned Judicial Magistrate, 1st Class, Sitamarhi in connection with Complaint Case No. 87 of 2024, subject to the conditions as laid down U/s 482(2) of the B.N.S.S., 2023 and also subject to the following conditions:

(II) The petitioner shall appear on each and every date fixed during the trial and also co-operate in the process of trial. (III) The petitioner shall not tamper with the prosecution evidence or influence/intimidate any witness during the course of trial.

(IV) The Petitioner shall not commit offence of a similar nature in future.

In case of violation of any of the aforesaid conditions, the Trial Court shall be at liberty to cancel the bail bonds of the petitioner.
