JUSTICE MOHIT KUMAR SHAH ORAL ORDER 07-10-2021 The present writ petition has been filed seeking the following reliefs:- "I. That by this writ petition, the petitioner craves indulgence of this Hon'ble Court for issuance of writ of Mandamus for directing and commanding the respondent authorities for payment of the admitted amount towards Bill for the work done under the contract entered into between the petitioner and the respondents on behalf of the President of India along with 18% interest on and above the amount from the date of Bill for the delay in payment and for issuance of any other writ(s)/ direction(s) order(s) as your Lordships may deem fit in the facts and circumstances

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the respondent no.3 i.e. the Divisional Railway Manager, Samastipur Division, Samastipur, East Central Railway for redressal of his aforesaid grievances regarding payment of the admitted outstanding contractual dues. The learned counsel for the Respondent State, Shri Akash Chaturvedi, AC to SC-11 has got no objection. Having regard to the facts and circumstances of the case, the present writ petition stands disposed of with liberty to the petitioner to file appropriate representation before the respondent no. 3 pertaining to Contract Agreement No. DRM (Elect)/SPJ/19/2018-19 and in case such a representation is filed within a period of four weeks from today, appropriate orders, in accordance with law, shall be passed within a period of six weeks, thereafter and in case any admitted outstanding dues is found to be payable, the same shall be paid within a further period of eight weeks, therefrom.
