ANJANA MISHRA ORAL ORDER 24-09-2015 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Harisidhi P.S. Case No.402 of 2012 (Tr. No.6808/12) for allegedly having committed the offence under Sections 447, 323, 324, 307, 341, 342 and 504/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that though the petitioner is named in the F.I.R. and is alleged to have given Farsa blow, yet in the final form submitted by the police, the petitioner having not been found at the place of occurrence, has not been sent up for trial.

Considering the aforementioned facts and

No.20340 of 2015 (2) dt.24-09-2015 2/2 circumstances and that there is one case against the petitioner instituted by the informant alone, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran, in connection with Harisidhi P.S. Case No.402 of 2012, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
