JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-406, 420 of the Indian Penal Code.

Petitioner is said to be a mason and took advance from the informant for construction of his house but subsequently, the petitioner digested the advance money.

Submission on behalf of petitioner is that the petitioner did the work of construction against the amount, paid to him but subsequently, the informant started pressurizing the petitioner to complete the construction work, without making any payment, which led to an altercation, for which, a Panchayati was held and after that, the informant lodged this false case.

Patna High Court Cr.Misc. No.11810 of 2016 (2) dt.16-03-2016 2/2 Taking into consideration the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Manigachhi P.S. Case No. 240 of 2015 to the satisfaction of learned Sub Divisional Judicial Magistrate, Darbhanga.
