Petitioners seek bail in a case registered under Sections-302, 34, 120(B), 341 of the Indian Penal Code and Section-27 of the Arms Act.
Petitioners are not named in the first information report and the informant claimed himself to be eye witness of the alleged occurrence and specifically, stated that it was co-accused Shashi Kumar, who shot fire on the deceased. Although the learned Additional Sessions Judge rejected the bail petition of petitioners but he failed to mention the fact as to how, the name of
Patna High Court Cr.Misc. No.11664 of 2016 (2) dt.15-03-2016 2/2 petitioners came in this case and what material was found against petitioners.
Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioners named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Saharsa Sadar P.S.
