JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 147, 148, 149, 341, 323, 324, 325, 307, 504 and 302 of the Indian Penal Code.

Petitioner is named in the first information report on the accusation that he instigated the others to assault the informant as well as other family members and after that the other F.I.R. named accused assaulted the deceased and others. From perusal of the impugned order, I find that after due investigation, police found the accusation untrue in respect of the petitioner and accordingly, he was exonerated from the case and final form was submitted in his favour, but learned court below differed with the

Patna High Court Cr.Misc. No.11247 of 2016 (2) dt.10-03-2016 2/2 findings of the police and took the cognizance against the petitioner also.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 8th Additional Sessions Judge, Vaishali in connection with Lalganj P.S.
