The petitioners are in custody in a case registered under Sections 302 and 201 of the Indian Penal Code. The prosecution case, in brief, is that the informant Suryadeo Yadav, who is a Chowkidar, has reported that one headless dead body was lying in the paddy field of Arjun Singh one Km. east of Panchar village and he has reported that said person has been murdered by some unknown persons. On the basis of his statement, FIR was registered against unknown. It has been submitted on behalf of the petitioners that petitioner No.1 and petitioner No.2 are in custody since 20.11.2014 and 24.12.2014 respectively and charge sheet has been submitted in the case. It has further been submitted that the petitioners are not named in the F.I.R. However, in course of investigation, the names of the petitioner have come. Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad, in connection with Khudwa P.S. Case No.40 of 2014.
