The petitioner seeks bail in a case registered for the offences punishable under sections 363, 366(A), 368/34 of the Indian Penal Code and section 12 of POCSO Act. The informant recovered girls from the manager and owner of the Orchestra party and alleged that they have got the minor girls for their exploitation. The I.O. only recorded the statement of one Sonka Mandal who disclosed that she and other girls were brought for dancing and this fact was known to their parents also. Father of Sonka Mandal also stated the same fact. Statement of only one of the victim was recorded who did not allege any sexual exploitation at the hands of the petitioner.

Patna High Court Cr.Misc. No.21569 of 2015 (3) dt.07-09-2015 Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge-cum-Special Judge, West Champaran at Bettiah in connection with Bettiah Mufassil (Manuapul) P.S. Case No. 138 of 2015.
