JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner and other F.I.R named accused had assembled in the house of the petitioner when the informant being officer-in-charge of Dobhi police station raided the house of the petitioner and arrested petitioner and others. In course of search, one country made loaded three nut was recovered from conscious possession of the petitioner and after that, the informant lodged the present case under section 399 and 402 of the of the Indian Penal Code and 25(1-b) A, 26, 35 of the Arms Act.
There is nothing in the self statement of the informant that petitioner and his associates had assembled to make preparation for committing dacoity. Moreover, for recovery of
Patna High Court Cr.Misc. No.11307 of 2016 (2) dt.14-03-2016 2/2 firearm, petitioner is in jail custody since 03.11.2011. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Sessions Judge IV, Gaya in connection with Session Trial No. 109 of 2015 arising out of Sherghati ( Dobhi) P.S.Case No. 362 of 2011.
