The petitioner seeks bail in Mirganj P.S. Case No. 176 of 2014 under Sections 366(A), 120(B) and 376 of the I.P.C. The mother of the victim made allegation that while her daughter was sleeping on the roof, the petitioner kidnapped her. When the informant woke-up in the morning she did not find her daughter.

It appears that the informant is not an eye witness of the occurrence. The victim herself appeared and made her statement under Section 164 Cr. P.C. The victim disclosed that the petitioner took her to his house and his father did not allow the petitioner to keep the victim in his house. Thereafter, the petitioner took the

It appears that the victim had some affairs with the petitioner and she voluntarily went alongwith the petitioner. The petitioner is in jail since 16.02.2015. Considering the facts aforesaid, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gopalganj, in Mirganj P.S. Case No. 176 of 2014.
