JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-04-2015 Heard learned counsel for the petitioner, learned counsel for the informant as well as learned Additional Public Prosecutor for the State.

Petitioner is named in the first information report and it would appear from perusal of the first information report itself that the alleged occurrence took place on account of land dispute and there is omnibus allegation of assault against the petitioner and two other accused though it is stated that petitioner gave rod blow on the scalp of the deceased. The injury report of the deceased as mentioned in para 56 of the case diary reflects that injured sustained altogether four injuries including injury on his scalp. Patna High Court Cr.Misc. No.4463 of 2015 (3) dt.23-04-2015 nature. The post mortem report of the deceased reveals that deceased died due to abdominal injuries. Moreover, co-accused, Awanish Singh and Rakesh Singh have already been granted privilege of bail by a co-ordinate Bench of this Court vide order dated 24.03.2015 passed in Cr. Misc. No. 1331 of 2015. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri S.K. Mishra, Judicial Magistrate 1st Class, Sikrahna at Motihari in connection with Ghorasahan P.S. Case No. 222 of 2014. (Hemant Kumar Srivastava, J) SHAHZAD/- U T
