Petitioner seeks bail in a case registered under section 395 of the Indian Penal Code.
No doubt, it is a serious case of dacoity but it appears that except confessional statement of co- accused, there is nothing against the petitioner.
Moreover, having more or less similar allegation several co-accused persons have already been granted privilege of bail by different benches of this court but learned Addl. Sessions Judge failed to take note of the aforesaid fact.
Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara in Piro P.S. Case no. 146/2014. shahid (Hemant Kumar Srivastava,J) U T
