2. The petitioner is apprehending his arrest in connection with Complaint Case No.C1-175/2023 registered for the offences punishable under Sections 498(A), 494/34 of the Indian Penal Code and 4 of the D.P. Act.
3. As per prosecution case, marriage of the complainant was solemnized with the petitioner according to Hindu Rituals and Customs on 23.05.2019. It is alleged that the petitioner and others assaulted the complainant and tortured her physically and mentally and also threatened her, that if one lakh rupees is not paid in dowry, the petitioner will perform second

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence as alleged in the FIR. The petitioner bears no criminal antecedent. He orally submits that complaint has been filed under Sections 498(A), 494/34 of the Indian Penal Code and 4 of the D.P. Act and learned trial court has taken cognizance under Section 498(A), 494 and 34 I.P.C. and 4 of D.P. Act and summons have been issued. He further submits that the petitioner is the husband of the complainant and presently both are residing together and they are leading happy conjugal life.
5. The learned counsel for the O.P. No.2 as well as A.P.P. for the State do not controvert the said submission and they further submit that both parties are residing together happily.

Considering the facts and circumstances of the case, keeping in view clean antecedent of petitioner, argument advanced on behalf of both sides and also taking into consideration the material available on record, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be
