The petitioner was arrested in course of investigation and his confessional statement was recorded. Similarly situated co-accused Raju Sah was also arrested and his confessional statement was recorded. After that the investigating officer has mentioned at para-71 of the case diary that on the basis of disclosure made by the petitioner and co-accused Raju Sah, the looted tractor was recovered from a lonely place and co-accused Raju Sah and Kishore Prasad have already been granted privilege of bail and the case of the petitioner stands on the same footing to that the co-accused.

Considering the facts and circumstances as well as
