The petitioner seeks bail in a case registered under Sections 406 and 408/34 of the Indian Penal Code. The Panchayat Secretary furnished S.B. Account for transfer of money from the District Board for execution of some scheme and amounts of Rs.3,52,600/- and Rs.3,74,589/- respectively were transferred in the Account of the petitioner. The petitioner withdrew the entire amounts.

Mr. Vikramdeo Singh, learned counsel for the petitioner submits that the petitioner has already deposited a sum of Rs. 3,52,600/- and he is ready to deposit Rs. 3,74,589/- within a period of four months from the date of his release.

It is submitted that the petitioner did not play any role in

Patna High Court Cr.Misc. No.19829 of 2015 (2) dt.17-06-2015 transfer of the money in his Account. The petitioner has only committed wrong that he withdrew the entire amounts and for that reason, he is in jail since 11.2.2015.

As it is submitted that the petitioner has already deposited a sum of Rs. 3,52,600/- and he is ready to deposit the remaining amount of Rs. 3,74,589/- within four months from the date of his release, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea in connection with Amour P.S. Case No. 308/2014. If the petitioner does not deposit Rs. 3,74,589/- within four months on his release, the learned court below shall cancel the bail bond of the petitioner.
