JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 34, 120B, 341 of the Indian Penal Code and Section 27 of the Arms Act. No doubt, petitioner is named in the first information report but according to prosecution case itself, it was co-accused, Shashi Yadav, who shot fire on the deceased. Moreover, having more or less similar allegation, one co-accused, Ashutosh Kumar @ Rocky Singh @ Rocky has already been granted privilege of bail by this Court.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with

Patna High Court Cr.Misc. No.13171 of 2016 (2) dt.01-04-2016 2/2 two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa in connection with Saharsa Sadar P.S. Case No. 87 of 2016.
